Can a doctor be liable for a bad circumcision?

My son is now 3 and from the minute his circumcision healed I noticed something just didn't seem right so I addressed it with the pediatrician several times. Everytime he would assure me that there was nothing to be concerned about and it would look more normal as he grows. Instead of the circumcision beginning to look better it only seemed to get worse so the pediatrician finally referred me to a pediatric urologist. He not only agreed that the doctor messed his circumcision up but my son now has to undergo a surgery lasting almost and hour to repair the problem. The sad thing is the same thing has happened with my 2 year old but his is not as bad, he will be seeing the urologist soon, yes the same doctor did them both. Can the doctor who did the oringinal circumcision be held liable?
Yes, a doctor can be liable for a bad circumcision. They're also supposed to give you all the pros and cons, potential benefits and risks, before you're allowed to consent to any procedure. If you didn't get any info prior to having your sons circumcised, you can hold the physician who did it liable for that as well. That can be serious malpractice there.

Too many people often assume that it's correct when a mistake may have been done, because the doctor assured them. Mistakes do happen, and more often than one would think.
If you had this happen to your first son, why did you put your second son through it?

While I suppose you might be able to pursue some legal action, I'm not quite so sure because you signed that waiver saying you WANTED the circumcision done. So, hey, you got what you asked for and everybody knows that circumcision has risks.

I'm glad you learned your lesson, but it's unfortunate that it had to be at the expense of not one, but both of your sons' penises.
You could certainly have a claim for Medical Malpractice against the doctor / medical center / hospital that performed the circumcizion. Contact your insurance company for advice.

Now this part is just my opinion but the risks associated with circumcizion far outweigh any apparent benefits, so I just hope if you have any more kids you won't opt for this unnecessary procedure again.
OF COURSE.... look, as many ridiculous, yet winning law suits prove, doctors can be held liable for tripping over your own shoe lace in the hospital parking lot. sounds like you have a real case though, go for it.
Yes you would hope so, but coming from a guy, why circumcise your poor boys to start with, leave the foreskin there and let them have some fun

I think that here in the UK it may be different with regard to the law, but I suspect that unless negligence can be proved there's not much hope. Did the same person 'do' your other son?
May I say though that you are a good example of a family where it can be seen that circumcision, unless on medical grounds, does go wrong even in these times and your actions add weight to those of us against this 'abuse' of our sons,
I sincerely hope that you can get things sorted out, but I would hate to have to suffer the pain and discomfort your sons must now endure.
I would hope the "doctor" would be held liable, but you will have to remember any settlement belongs to the victim, it is his penis after all that got mutilated. I am glad to hear that you have learned a lesson, it is unfortunate that your sons have to live with the cost of your education (a warning to other parents contimplating circumutilation)

Please use your education to help end this horrid practice, your sons are not the first to be maimed and sadly I must say they will not be the last.

Yes probably, but the issue is more your fault than the doctors to a certian degree.
You never should have had that child mutilated in the first place.
So the doctor will claim that you requested the mutilation be done. Although he botched the cut, he would claim that you wanted to purchase the mutilation process and the child did not need the mutilation to begin with, but you are on your own and now the child will have to suffer the rest of his life because you wanted to cut off part of his penis.
Live with it because the child will have too.
Unfortunately, you probably don't have a case unless the doctor failed to give you informed consent or negligence. There is a good amount of case precedence. Here is an example:

When you signed the consent form for the circumcision, you also signed that you understood there is a possibility of complications and unsatisfactory results.

But feel free to sue, anything that will stop infant circumcision is a step in the right direction.
Absolutely. Don't take this wrong, but as a gay man I have seen a penis where the head had somewhat of a skin attachment from the shaft to the head of the penis. It actually looked like a space yet skin connected the two. It was most unusual and this gentleman was self conscientious so much that he wanted to have surgery. I don't know if he did or not. I hope you can sue the surgeon. Did he pull up the foreskin too much and disfigure the head ? I would contact an attorney for advise but my guess would be yes. It's no different than breast surgery that has gone awry. Go for it and good luck.
It would depend on the laws where you live, why the circumcisions ended up that way. Mainly, if the doctor was actually negligent or not. If that could be shown, then yes you could try and seek compensation.

There are those "no win no fee" lawyers out there who sometimes take on cases like this, I would imagine if you look in the phone book there would be some who would give you a free consultation anyway to determine if there's a case or not.

There are some terrible side effects, that unfortunately count as "normal complications" from circumcision, so what happened to your sons could have been mentioned as a potential outcome when you signed the consent form. I'm glad you've now learnt that circumcision is a bad idea and hope you won't do it to future sons and will warn others off that doctor/the procedure if you know any friends planning to see him or whatever.
